To boost economic cooperation between cross-straits, continuous negotiations and models from multi-state’s economic cooperation can lead to build mutual beneficial treaties at the same time protect domestic market for both sides. Laws and regulations bestow the functions to limit treaty, protect domestic market and superintend entrepreneurs. Hence, the reason to explore the thesis is, by means of laws and regulations, how to analyze the range of opening and the influences of telecommunications market between China and Taiwan. Next chapter is analyzed by cross-strait telecommunication history. The emperor, Lee Shih Ming, in Tang Dynasty of China ever said “Taking bronze as a mirror could check the outfits; taking history as an example could alarm the regime; taking people as the model could review the deeds, I always keep these three criterion in my mind against making any faults.” To discuss amends and defects in laws of telecommunication, the past laws are the bases for the discussions ranging from History, Law and Market. Both Taiwan and China are the members in WTO, under WTO, GATT and GATS are the trade constructions to regulate economy, trades, market and limitation. To boost economic growth, member nations are entitled to have better chances of multiple economic cooperation than non-member nations. However, why ECFA has been the standard to be followed in Market and Sevices opening? Do scrutiny and market open in the cross-strait economy and trade treaty bring impact to China and Taiwan? Can market open be advantage or disadvantage or constant as usual for telecommunications? This paragraph will analyze and assess the chances and the challenges in telecommunications of both sides under GATS of WTO and Cross Strait Agreement on Trade in Services. Telecommunications have privatized state-run enterprises, which has been the most significant achievement after participating the trade organizations. Yet, telecommunication infrastructures still possessed by few enterprises. Is it possible the infrastructures will be full-scale privatized after Cross Strait Agreement on Trade in Services are passed? Undeniably, 4G-LTE is the latest telecommunication technique containing communication, internet and payment. Although Taiwan and China set certain statues for radio spectrum and its bids, with implementing Cross Strait Agreement on Trade in Services, will privatization of telecommunication cause any odious effects on country safety and people’s privacy? To 4G-LTE, from the facet of Cross Strait Agreement on Trade in Services to telecommunication market, will Taiwan and China follow the agreement to thrive regional prosperity with mutual cooperation of techniques and economies? This paragraph will put the telecommunication privatization and 4G-LTE to the axis to discuss if it is eligible to include telecommunication market in Cross Strait Agreement on Trade in Services. The last paragraph will analyze, between WTO and ECFA, which one is more suitable and beneficial and even can achieve regional economy development for cross-strait telecommunication market.
