The implementation of PPP has reduced government spending, increased revenue, and created job opportunities since the establishment of laws. However, there are dispute existed in the outcome review owning to the lack of knowledge and experience in the public sector. Current issues and the common misunderstanding on the PPPs become the frequent amendment of contracts to strengthen governing authorities but yet diminish bargain power of the concessionaire. This leads to conservatism to investors. These problems often exist in emerging markets and the government should take pro-active initiative to promote the construction industry. The research project began with the literature review of the actual practices from the international financial institutions. A real case in the U.S. is compared with a similar one in Taiwan. The purpose of case comparison meant to show the differences and shed the lights on the future direction of improvement. The conclusion draws the need to build the future well-being of the majority of the traffic community, from both law and responsibilities perspective. The true definition of "public interest" is no longer a question as how much the government or private group earned, instead, people ask how many engineering projects had been carried out. To achieve this goal, the contractor should be familiar with the relevant laws and regulations, the government further relax regulations and actively seek flexibility and adaptive measures, prioritizing the people and services, rather being governed by law.
