Design education in Taiwan has been developing for 50 years, while higher design education plays the key contribution on fostering design professionals in the island. How to strengthen the designer’s legal literacy, and then balance the application of the design creativity and protection of intellectual rights have become the important topics on design education. The study, having made the relevant intellectual property (IP) laws and litigation cases as a starting point, is based on the need of law knowledge for higher design education. The document analysis methodology is applied on the current situation of law course materials and syllabus planning of IP rights to analyze the development of current design education. After analyzing the data comparatively, then the 18-weeks pedagogy is summarized after integrating the proper thematic curriculum. It also applied expert interviews method to clarify the requirement and difficulty of legal education on design field. From the study of IP litigation cases, the evidence of Iconology Research Method is the base of judicial determination on the likelihood of confusion. 10% is the general criterion. Litigation case study should be properly included in the curriculum. Those enable students to possess the law knowledge fulfilling the design industry development trend. The objective is to understand the implementation status of the law curriculum in the design relevant departments, then analyze the similarities and differences of their intellectual property rights curriculum planning. It offers as a reference to future development of legal education in the design school. The conclusions and recommendations in this study are 1. Appeal to the Ministry of Education for policy implementation and to colleges for supporting the dedicated IP curriculum on design school in order to meet the needs of design talent education and the future development. 2. The teaching faculty is an essential factor curriculum planning. The dedicated professional design and legal scholar should be recruited to fulfill the needs of student’s learning. 3. Multiple IP rights curriculum planning is indeed the trend. Constructing the suitable IP right curriculum of design field is essential to make the design and law complement each other. 4. Case teaching is the method of experience heritage and problem-solving, it should be implemented and balance the legal practice and theory revision. This is the important continuity of design education.
