This study discusses the efficacy of the new amendment to the Agricultural Development Act (hereinafter ADA) in Article 18-1, which attempts to prevent those who are not engaged in agricultural activity, but rather belong to a consortium, from causing speculative chaos by attempting to obtain profits through the purchase of farmhouses on agricultural lands. In addition to undertaking a study of the relevant literature, the author chose Shihu Township near Miaoli for a case study. Interviews were conducted with real estate agents, landlords, farmhouse owners in the greater Miaoli area, as well as the employees of the Farmer’s Association and County Head for this research. An examination of the relevant literature leads to the following results in this study: 1. The new amendment to the A.D.A is strives for“farmland for agricultural usages.” It has an insignificant effect on the rights and interests of farmers who actually engage in agricultural production. However, a majority proposes canceling the limitation that mandates a 0.25 hectare separation between farmland and farmhouses. 2. With respect to the coexistence of farmland and farmhouses, this research suggests it is necessary to return to the original intent of the new ADA amendment in Article 18-1, in addition to the legislative decrees, and that founding a platform for negotiations will lead to greater mutual understanding. 3. To accommodate the policy of“farmland for agricultural usage,” this research suggests the “diversification of farmland usages” and “an interdisciplinary cooperative platform” to encourage youth to return to agricultural villages and develop delicate agriculture or the integrated usage of farmland. The diversification of homeland usage will stimulate the economy of the agricultural village. Otherwise, the diversification of farmland use cannot be realized. In Shihu Township this study used a questionnaire and qualitative research and analysis to arrive at the following results: 1. The trend of farmland sale transactions has not dropped significantly. On the contrary, it has increased slightly. 2. Farmland purchases, or the approval of loans on farmhouses, will not be impacted. 3. The value of farmland and farmhouse will be the same as before the policy amendment – NO depreciation, or will continue to appreciate. 4. People support the newest revision of farmland policy. However, they state that “farmland for agricultural usages” is not only a problem of land policy, but also for agriculture as a whole. Finally, this research bases its conclusions and suggestions, as well as suggestions for further research, on the above-cited results.
