Summary:碩士 === 國立臺北大學 === 法律學系法律專業組 === 104 === Consumer Protection Law in our country has been amended in June, 2015. The amendment tried to solve the problems of right to cancel in Consumer Protection Law which has existed for a long time. The amendment of Consumer Protection Law mostly refers to 2011/83/EU. The British government tried to convert 2011/83/EU into the British law because the requirement from 2011/83/EU. The British government then announced Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 on December 13, 2013. Therefore, this thesis will compare our Consumer Protection Law with Consumer Contracts Regulations 2013 and manage to find the balance of benefits between the consumer and the trader. This thesis will introduce the background and content of the right to cancel, and discuss the application and the problems of the right to cancel in our law in the past. Besides, the study will analyze the trader’s duty of providing information and discuss the related issues of exercising the right to cancel from the consumer. Most important of all, this thesis will take Consumer Contracts Regulations 2013 as comparison. The study will mainly introduce the elements of the right to cancel and the exercising of the right to cancel. In the end, the study will compare our amended Consumer Protection Law with Consumer Contracts Regulations 2013 on the issues of the right to cancel.
