| Summary: | 碩士 === 中華大學 === 科技管理學系 === 105 === The purpose of the Government Procurement Act is to make the procurement process can be open and fair justice, make the government organizations obtain the quality of the target. However, from the opening of bid to the acceptance test, the government and supplier have different point of view of the Government Procurement Act terms, often have the controversy of procurement, so the Government Procurement Act establish a unique objection, complaint handling mechanism. The Government Procurement Act clear stated supplier may have violation behavior, under the Government Procurement Law, Article 101 to Article 103 set up the regulations to punish of the debarred Supplier. However, the Government Procurement Act has been in operation since May 1999 for 18 years and still has some different perspectives of the opportunities to use Article 101.
In this study, use the government's electronic procurement network announced the rejection list of supplier from January 1, 2014 to March 15, 2017 the debarred supplier as the main sample, use to do the literature search and analysis the government procurement act 101 to explore the reasons and the response.
That the results and suggestions of this study will be able to provide government the reasons for the debarred Supplier, reduce controversies, and summarize the reasons for frequently suspension. In the future procurement, government and supplier in the procurement process should reduce the controversy, and execute the procurement process fair, reasonable and effective.
