碩士 === 開南大學 === 人文社會學院法律碩士在職專班 === 105 === This study can be separated into 3 parts: The first part consisted with the brief descriptions of the Government Procurement Act and adverse vendors which took foreign legislations, theories controversy, and the changes of practical opinions to make analysis. The second part stated that taking 155 trial resolutions from 25 December 2010 to 4 February 2017 of the New Taipei City Complaint Review Board for Government Procurement (CRBGP) as samples to make typical induction. Then distinguishing all the resolutions into adverse vendors dispute, tender, bid, and award of bid dispute cases. Moreover, separate adverse vendor dispute cases into “Unaccepted”, “Rejected”, and “Repealed” types by the judgements to statistic the numbers and the types and track the amount and verdict of the cases which was rejected and filed an administrative litigation. The final part had tried to take the judgement of the New Taipei City adverse vendors dispute cases to make a verification with theories, and proposed the observations of adverse vendors system and the suggestions for the New Taipei City to amending or practical operation’s references.
