Summary:碩士 === 國立中興大學 === 法律學系碩士在職專班 === 105 === Recently, there are so many criminal medical malpractice lawsuits in Taiwan. We searched all the district criminal court’s medical malpractice judgements in Taiwan during the period of 2000 to 2012. The research selected 235 cases for further analysis randomly. Due to the complexity of medical malpractice lawsuit, the traditional studies in medical malpractice focused mainly on identifying the fault or establishing the medical routine and other legal empirical studies focused on factors affecting judgement. These studies could not help to predict the judgement before prosecution. Now, we could use Microsoft Azure Machine Learning to do further analysis and forecasting. We provided the forecast information. The research may assist the plantiff and the defendant to make the adequate decision and reduce the rate of prosecution.
