Summary:碩士 === 國立成功大學 === 法律學系 === 105 === Taiwan government develops Organic agriculture positively over three decades; however, the result is not significant. This thesis intend to seek for the answer of the poor development of Organic agriculture. The current policy tends to be fragment and deficient, thus, this study has sought out several suggestions to resolve these issues. First, the thought of the agricultural policy in Taiwan has to be changed; second, organic 3.0 has to be introduced from other country; and the third, an organic agriculture law has to be urged into legislation. This thesis tried to further discuss the legitimacy of Organic agriculture law from the perspective of Constitution Law, focused on the basis of Organic agriculture protection, and industry entity right protection. It came out with a result that constructing an organic agriculture shall be protected by law under our Constitution. After reviewing current regulations on Organic agriculture in other countries, this thesis came into a conclusion that Taiwan’s Organic agriculture law is too scattered to response to the requirement of our Constitution. Hence, this thesis tried to advocate for legislation of Organic agriculture law and bring in new idea about Paradigm Shift and organic 3.0 in order to fill the gap of Taiwan law of Organic agriculture.
