Summary:碩士 === 國立中央大學 === 法律與政府研究所 === 105 === ABSTRACT The issues about right and interest and the legal standing of the people passing Civil Service Examination is the main research topic of this thesis. First, the author explored the standing of the people passing Civil Service Examination and confirm whether they are official civil servant. Then, compared the difference between them and the official civil servants to establish the standing of these people during training period. Second, this article explored the relevant rights and interests of the people passing Civil Service Examination, including the systems about training, subsidies and insurance. 1. Compare the difference of the allowance during the training period and the pay of official civil servants. 2. How to grant the benefits and survivor allowance of the training period? 3. Can these people participate in the government employee insurance during the training period? The other right-related issues about indemnity and retirement were also be discussed in this article. In addition, this article also introduced the civil servants systems of mainland China. Analyzed right and obligation of the civil servants and right of the people passing Civil Service Examination in mainland China. Finally, the author established the standing of people passing Civil Service Examination during training period by exploring their relevant rights. This article also reviewed the lack of the rules about the people passing Civil Service Examination in Taiwan and put forward some suggestions.
