碩士 === 國立中山大學 === 政治學研究所 === 105 === In 1987 after the lifting of the martial law, the Third Special Police Corps, National Police Agency is responsible for taking over the part of the import container safety inspection work, while the Customs administration, Ministry of Finance is responsible for the tax investigating. The Third Special Police Corps and the Customs also carry out inspections in parallel in the port area.With the changes in time and space and political factors, the scope of inspections of the Third Special Police Corps has gradually been reduced, and the status quo is retreated to the final stage and the outermost circumstance of the whole import container clearance procedure for safety inspection. After martial law was lifted the Third Special Police Corps burden import container security inspection tasks, but the relevant legal system was not constructed at the same time, leading to the lack of authority on the existing duty, and more importantly, its main reason for withdrawing from inspecting in port area. With the rise of free trade, the nature of smuggling has changed. Because people''s livelihood around the world have been able to free flow of supplies, smugglers then transferred to smuggling guns, weapons, drugs, tobacco and other dangerous or controlled items in order to reap huge profits. In the face of the changing trend of smuggling objects, the border policies of countries around the world have also been gradually transferred to emphasizing national security compared with the tax inspection. Taiwan is also facing the current guns, drug abuse, and follow-up lead to crime cases and social problems. Therefore, the role of the Third Special Police Corps in preserving the order of the border should be re-examined. In sum, based on five major structures—Fundamental Theory, Administrative Organization, Administrative Authorities, Administrative Remedy and Administrative Supervision, with approaches of literary research, historical research, comparative analysis and inductive reasoning, this dissertation aims to re-discuss the Third Special Police Corps in the border order of the role ,and examine the implementation of the Third Special Police Corps of the current situation and difficulties in the import container safety inspection, and then put forward the direction of the adjustment. Look forward to let the legal system regarding the Third Special Police Corps more perfect.
