碩士 === 國立臺北大學 === 經濟學系 === 105 === In Taiwan, comparing the land reform by Kuomintang with the one in Japanese-Occupied Period is commonly discussed in Taiwan. With so many researches, however, there is barely discussing the topic in property rights and transaction costs sight. Hence, we try to use them to analyze the two periods’ land reform. We found out that land reform in Japanese-Occupied Period defined ownership and encouraged people to sign literal contracts rather than oral ones. The reform resulted in certificating ownership and landlords being able to rent their lands. Otherwise, policing and enforcement costs is decreased for literal contract as a proof in the court. On the other hand, land reform by Kuomintang not only defined ownership but also ensured the right of use, which is the most important of land renting market. Even more, enforcing literal contract on landlords and tenants and limiting the quantities of land people owns are important in this land reform. And we can know the land reform by Kuomintang brings about the ownerships and rights of use defined and decrease in transaction costs, including search and information cost, bargaining cost and policing and enforcement cost. Therefore, we reason that land reforms in two periods boost different parties to produce. That is to say, the one in Japanese-Occupied Period increase the land input and another by Kuomintang made farmers have incentive to cultivate.
