Summary:碩士 === 國立中正大學 === 犯罪防治碩士在職專班 === 106 === Under the aged society and lower birth rate in Taiwanese labor market, the situation makes the lack of labor in the dangerous, dirty and low-wage industries. To solve the problem of labor shortage, the government recruits blue-collar foreign workers. The measure makes the problem solved, but it also causes other social problems, like runaway foreign labors, which is the problem that the government has not solved efficiently so far. The paper focuses on the foreign labors encounter the situation of victim when their whereabouts are untraceable, and analyzes types of crime, modus operandi and crime patterns by data collecting and compaction, and then suggests how to improve the hard situation. The paper found: First, the analysis of types of crime are labor exploitation, sexual exploitation, offenses against sexual autonomy, personal freedom and property rights of foreign labors. Second, the crime patterns are 4 kinds, the infringement from civil servants, organized crime, joint offenders and individual. Third, most of all, defendants use the disadvantaged states, like illegal resident, incomprehension of Chinese and laws and helpless situation. After analyzing the findings and related literature, the paper suggests: amend Employment Service Act, educate Taiwanese employers, agents and foreign workers the concepts of human trafficking and Employment Service Act, Ministry of Labor should regulate the working conditions of household assistants and nursing workers, train professional interpreters to assist investigation and trial efficiently.
