The Brand-name Drug has been invested a lot of manpower, material resources, financial resources through a professional medical team for a long time research and development which it should be granted patent protection and respect. If there are conflicts among the patent of the Brand-name Drug, the right to human life, the maintenance of public health, and biological genetic engineering infection, which is the most important? Thus, the importance of the patent needs to be reevaluated.The generic drug imitates the patent of the Brand-name Drug when it is close the expiry date of the patent. According to the drug Inspection and Registration review guidelines indicates that the drugs have the same composition, the same dosage form, the same dosage, and the same treatment effect then the generic drug can be launch. However, the Brand-name Drug in the patent application process, according to the business secret law, as long as to make public of the minimum standard and qualified to obtain a patent. Without these key unpublished data, will the efficacy of generic drugs be equivalent to the original? This has yet to be studied. Taiwan has set up the public and labor insurance system 6 decades ago. If there was no public, labor insurance when you go to see a doctor, you need to pay at your own money, whether or not to use the Brand-name Drug or generic drugs depending on the patient's economic status. After the compulsory implementation of National health insurance from 1995, medical treatment expense paid by the health care department. In the event that the public does not cherish the medical resources, the Department of Health Care has gradually become financially deficit. So they take a task, its name is to adjust the amount of health insurance payments, which is actually take a big cut in drug prices, forcing the medical institutions to replace the original Brand-name Drug with a generic drug. What is the right thing to do? Therefore, this article aims to explore the patient’s acceptance of the substitute generic drugs for Brand-name Drug. This study develops both network and paper questionnaires to measure the patient’s acceptance of the substitute generic drugs for Brand-name Drug. This research uses the theroy of planed behavior (TPB) to investigate the patient’s acceptance of the substitute generic drugs for Brand-name Drug. The empirical result shows that the perceived behavior control has a significant impact on the subjective norms; the subjective norms has a significant impact on attitude toward the behavior; the subjective norms has a significant impact on intention; attitude toward the behavior has a significant impact on intention; intention has a significant impact on behavior. This study finds that female patients are less aware of the Brand-name Drug and generic drugs. High degree education people think the efficacy of the Brand-name Drug is superior to generic drugs. When patients (and their families) in small trauma and small cold situation are willing to use generic drugs. However, when the patients (and his family) are suffering from a major disease is willing to change back to the Brand-name Drug and pay the bill at their own expense.
