Until today, the patent right was no longer solely for the protection of its patented technology, but rather as a profit-making tool. Judging from today's judgments, there is no need for substantive commercial activities to be more commercialized. Sales have gradually shifted to technical applications and the recognition of infringement damages has become increasingly difficult. Patent litigation and compensation related issues in the country have many scholars attention, Shuo students also discussed various, most of them single-oriented discussion, the main single discussion such as patent litigation, infringement elements, etc., as the study of compensation after the infringement has gradually become hot , For the relevant research scholars, advanced have made their views. However, with changes in commercial behavior and compensation after infringement, the compensation is becoming increasingly complicated and difficult. Some scholars in China have also discussed the introduction of other fields as a supplement. Therefore, it is necessary to introduce other fields of practical legal practice into practice. In this paper, the calculation of tort damages in Taiwan, China and the United States are preliminarily arranged in the second to the fourth chapters, and several current patent appraisal methods are introduced.
