碩士 === 華夏科技大學 === 資產與物業管理系 === 106 === With the evolution of social and economic prosperity in Taiwan，the living pattern is transformed from the townhouse into an apartment，the current residential form is mainly in buildings or communities，to perform the management and maintenance work of a building or community，The management committee formed by the tenants has emerged．The management committee must enter into a contract with the management service for the renovation, management and maintenance of public facilities，appointment or hire to perform administrative maintenance services．When a tenant is caught in a burglary case，the purpose of this study is how to make a claim to the management service person．Collect 40 cases of household and management service personnel for claims of theft，through the statistics and analysis of the collection, understand the disputes between the tenant and the management service person，the verdict and reason of the judge's judgment on the point of dispute and the reference of the legal source，as a tenant in the theft case of the claim strategy reference． The study obtained four results，acquisition of the "claim for damages" of tenants，Civil Law and Consumer protection law can be used to obtain a strong claim for damages，In case of demand for compensation for loss of theft cases，the management committee shall, when signing the contract of appointment, include the recommendations of the clause and the management of a service person in the execution of a contract, the management Committee must confirm the matter.
