Therefore, in order to ensure the safe and healthy life of the people, the state is duty-bound to the protection of national health, and the establishment and improvement of the food safety management and legal system is of great importance.   In Taiwan’s food safety management and legal system, in addition to establishing a set of health and safety standards for food and food businesses, the current Act Governing Food Safety and Sanitation also has a supervision and control mechanism for food examination. Regulations on food examination give the competent authority the authority to conduct administrative investigations on various food safety incidents as a preventive measure to confirm whether the food is harmful to the health of the national and prevent the occurrence of national victims. Therefore, how the administrative investigation of the Act Governing Food Safety and Sanitation operates, including the organs, elements, methods of investigation, etc., and whether there is room for improvement, is necessary for further understanding.   In this thesis, the food safety management and legal system of the current Act Governing Food Safety and Sanitation has been comprehensively organized and summarized, and then by the observation of administrative practice and judicial practice, the issues on the implementation of food safety administrative investigation has been clarified as well. This thesis also takes the Japanese Law as a reference, and tries to find out the similarities and differences between the food safety administrative investigation system jointly constructed by Japan’s Food Safety Basic Act and Food Sanitation Act. The results of the comparison are believed to be the future direction of Taiwan’s food safety administrative investigation system and would help it become more perfect.
