However, dispute transaction is unavoidable and unable to solve since the deferred pay off from the whole procedure. The dispute resolution is important to support credit card system. Through literature review and case study, the study refers the development and transaction procedure of credit card, and concludes the nominate contract of Civil Law cannot explain the legal relation of the party in the system. Moreover, the definition of the dispute transaction becomes different by deference of dispute resolution. When discuss the chargeback procedure ruled by credit card company, the defense right and the other party exercised shows inconsistent with Civil Law; moreover, it may cause the risk shift.
