Opioids have directly triggered the decline of the Qing Dynasty, and the related drug abuses continue to haunt modern society. Taking drugs is not only abuse to individual health. Drug addicts would be affected in their mental capacities and lead to the harm of others. They may even commit other criminal acts to obtain financial resources for purchasing drugs. Drugs are also related to gangs and money laundering. Drugs are a peril to society. Innovations in criminal techniques and the types of drugs have grown by the day. International trafficking of drugs brought further challenges to the crackdown of drug-related criminal cases. Many drug addicts would relapse after a period of drug abuse treatment and show less than the desired result in drug prevention. The above are all problematic challenges to the governments across the world. The two governments across the Taiwan Strait share geographical proximity, common ethnicity, culture, and language, all of which are factors that contribute to the convenience of drug trafficking and drug-related transactions. Therefore, there is a need to conduct integrative research on the legal and administrative systems of drug management. This author proposes to approach the systematic study of the legal and administrative system of drug management from five aspects based on the Five Major Frameworks of Administrative Law derived from theories of legal policymaking and administrative process. The five aspects, including the principle of administration, administrative organization, limits of administrative authority, administrative remedy, and administrative supervision, form the basis for a well-rounded approach to analyze the legal and administrative systems of drug management. Additional methods taken include literature review, historical research, comparative research, and inductive reasoning. Together the research focuses on the issues of preventive prohibition and drug addiction treatment to provide observations and remedies for the current legal and administrative systems of drug management across the Taiwan Strait. The critical principle highlighted in this paper is the parallel process of prohibition and treatment to advance the problem of drug management on both sides of the Taiwan Strait.
