碩士 === 實踐大學 === 企業管理學系碩士班 === 107 === Though Chinese Professional Baseball League (CPBL) has operated for thirty years, there are still some problems in the system. Compare with Major League Baseball (MLB) in the U.S, CPBL lacks of the protection for player’s right and the system for dealing with the dispute between players and teams. Those problems would affect the development of CPBL negatively. Long before CPBL was founded, MLB already had free agency and salary arbitration systems. However, until now, in CPBL there are still some problems around the free agency system, and CPBL has not established a defined salary arbitration system. Recently, there were some controversies for that CPBL arbitration system may not judicially enforceable. And comes about applying for salary arbitration. But because there is not salary arbitration system in CPBL, the league only could only use general arbitration to deal with these case This research aims to recommend the better systems of free agency and salary arbitration in CPBL by comparing with MLB systems and analyzing of real cases.
