In 2018, the Government of Malaysia has enacted a law regarding the fake news entitled as the Anti-Fake News Act (AFNA 2018), however, after the Malaysian General Election, the newly formed parliament repealed the Act and therefore the Act was abolished. This thesis firstly aims to analyze the sufficiency of Malaysian Communication and Multimedia Act 1998 (CMA 1998) and the Printing Presses and Publications Act 1984 (PPPA 1984), also to investigate if the AFNA 2018 is needed to be reused to regulate fake news issues. Secondly, this thesis also looks into the laws and regulations of other countries to provide suggestions and comparisons for the references of future usage of the Fake News Law. In addition, the thesis also discusses the use of the term “Fake News” to know whether it should be replaced by misleading of disinformation or remain the same.
