碩士 === 國立交通大學 === 科技法律研究所 === 108 === Abstract In recent years, FinTech has advanced rapidly, providing consumers more diversified financial services, but such rapid advancement also poses challenges to financial regulation and supervision. The UK first proposed the concept of Regulatory Sandbox in 2015, enabling innovators to test novel products and business models in a “safe space.” Taiwan implemented the "Financial Technology Development and Innovative Experimentation Act " in 2018, which established the regulatory sandbox regime of our own. Past literature has reviewed details of Regulatory Sandbox. However, for the innovators, the feasibility of commercial launch outweighs the experiment itself. This article reviews the post-experimentation phase of the financial Regulatory Sandbox regime and analyzes the transition of financial innovation from regulatory sandbox to commercial operation. By learning from early experiences in the UK, Singapore, the Netherlands, and Australia and through conducting interviews with local experts, we identify issues posed by Taiwan’s current practice and provide recommendations for FinTech regulation and supervision in Taiwan.
