Das Rechtskonzept "Kindeswohl" ist erst seit wenigen Jahrzehnten als das zentrale familienrechtliche Leitprinzip anerkannt und insbesondere hinsichtlich der konsequenten Bezugnahme auf die Persönlichkeitsrechte des Kindes als zeitgeschichtliches Phänomen des 20. Jahrhunderts zu betrachten. Die vorliegende Arbeit befasst sich mit der Entwicklung der gesetzlichen Verankerung und Konkretisierung des Kindeswohl-Prinzips sowie dessen Interpretation durch die Rechtsprechung in den ersten 100 Jahren seit Inkrafttreten des Bürgerlichen Gesetzbuches. === The legal concept known as the "wellbeing of the child" has not been recognized as the fundamental legal principle of law of domestic relations until several decades and especially in what concerns the consequent relation to the right of personal rights of each child it has to be considered as a historical phenomenon of the 20th century. The dissertation in question deals with the development of the codification and with the appropriation of the principle as well as with the interpretation of the adjudication in the first 100 years since the German Civil Code has come into force of law.
